Message #5 received at submit@bugs.debian.org (full text, mbox, reply):
Package: lintian
Version: 2.5.31
Severity: important
Dear all,
while building TeX Live package I got warned by lintian that the
ICC profile
sRGB_IEC61966-2-1_black_scaled.icc
is unfree, and lintian helpfully related me to the package
icc-profiles
(in Debugs-CC header).
Now checking the copyright file of icc-profiles and the *actual*
copyright statement on the download page:
http://www.color.org/profiles2.xalter
states clearly:
**************************
Licensing
The copyright owner and terms of use of an ICC profile are normally identified in the Creator field in the profile header and in the Copyright tag. Where ICC is the copyright owner, the following license terms apply:
"This profile is made available by the International Color Consortium, and may be copied, distributed, embedded, made, used, and sold without restriction. Altered versions of this profile shall have the original identification and copyright information removed and shall not be misrepresented as the original profile."
***************************
On the other hand, the icc-profiles package lists the copyright in a
different form:
*******************
Files: sRGB_* ISO22028*
Copyright: International Color Consortium <icc_users@lists.color.org>
License: ICC
To anyone who acknowledges that the files
"sRGB_IEC61966-2-1_no_black_scaling.icc" and
"sRGB_IEC61966-2-1_black scaled.icc" are provided "AS IS" WITH NO
EXPRESS OR IMPLIED WARRANTY, permission to use, copy and distribute
these file for any purpose is hereby granted without fee, provided
that the files are not changed including the ICC copyright notice
tag, and that the name of ICC shall not be used in advertising or
publicity pertaining to distribution of the software without
specific, written prior permission. ICC makes no representations
about the suitability of this software for any purpose.
******************************
I would therefor suggest two steps:
* first move the ICC profiles to
icc-profiles-free
* remove the lintian error
Thanks
Norbert

This doesn't appear to give permission to modify the ICC profiles?

As with LPPL (1.3c, Clause 5&6) and many other programs (tex itself),
if you change it, change the name. Changes *are* allowed.
The license statement in icc-profiles does not allow for selling,
AFAIS. That is the main stumbling block, IMHO.

Can you quote the part of the license that allows changes?

Altered versions of this profile shall have the original
identification and copyright information removed and shall
not be misrepresented as the original profile.
Doesn't that clearly state that *altering* the files is allowed,
under usual renaming clauses.

Doesn't appear to be a clear statement to me. I would expect something
like ... and may be *modified*, copied ... in the other part.

Umpf, is this something we have to bring to debian-legal?
IANAL, but I see *several* open source projects including these iccs
nowadays.
Anyway, I am out here. There is nothing more I can contribute
(besides that I simply will add a lintian override)

Huuu, how can a wrong lintian warning/error be a reason for
ftpmaster autoreject when it is overridden.
There is a new license statement included in the packages I made,
and if *lintian* believes it is wrong, so it might be, but that
does not mean it is like that. THis is open for debian-legal
to decide, not lintian.

Please ask an official statement from ftpmaster (open a bug) about thé new license. And block this bug by the ftpmaster one. I will be glad to do everything at ftpmaster guidance
I have added these files in order to ease FTPmaster work and with their blessing.
I do not want to substituée with ftpmaster.

Hi Norbert / Lintian maintainers,
As requested, we discussed this license at the ftp-team IRC meeting.
We're satifisfied that the intention is to allow modification and would
therefore ask the lintian maintainers to consider changing the check.
Thanks,
Mark (on behalf of the ftp-team).

Dear norbert,
Could you check if the term you quote really apply to the file
sRGB_IEC61966-2-1_black_scaled.icc ? I think the term you quote
apply only to test profile. Care to prod upstream ?
Maybe the website is not updated....
Thanks
Bastien
* See http://www.color.org/srgbprofiles.xalter
Before downloading
sRGB_IEC61966-2-1_black_scaled.icc I must agree to this non free legal term:
v2 profiles
An ICC version 2 (v2) sRGB profiles is provided below, with XYZ black
point scaling to zero. This 'black scaled' profile has the preferred
rendering intent in the header set to 'perceptual'.
The profile contains the standard linearized Bradford D65 to D50
chromatic adaptation tag (this tag was often not present in older sRGB
profiles), and the media white point tag is set to D50 (as is required
for ICC v4 display profiles). This avoids the inappropriate color
casts that older sRGB v2 ICC profiles sometimes produced when the
absolute colorimetric intent was used.
The profile will work correctly when either Black Point Compensation
(BPC) is on in the CMM/application, or the other profile transform to
be used for the conversion is also black scaled. Black scaled profiles
are needed when BPC is desired for the conversion but the CMM to be
used does not support BPC. Most v2 sRGB profiles in current use are
black scaled because they are intended to be used as the source
profile in conversions where the destination profile perceptual intent
will be used (v2 perceptual transforms typically include black
scaling).
NOTE: This profile was revised in February 2015 to bring the black
point tag into alignment with current ISO and IEC recommendations.

Dear phil
Some file on your website seems to have contradictory license terms:
On http://www.color.org/profiles2.xalter you said:

However on http://www.color.org/srgbprofiles.xalter you said:
>To anyone who acknowledges that the file "sRGB_IEC61966-2-1_black scaled.icc" is provided "AS
>IS" WITH NO EXPRESS OR IMPLIED WARRANTY, permission to use, copy and distribute these

Could you document clearly what is the license term of individual file ?
Bastien
PS: in order to include only once the license term on your website you
could use jquery
like this
<html>
<head>
<script src="jquery.js"></script>
<script>
$(function(){
$("#includedContent").load("b.html");
});
</script>
</head>
<body>
<div id="includedContent"></div>
</body>
</html>
Added tag(s) upstream.
