I cannot reproduce the problem. I just successfully upgraded from
7.0.68.0.1 to 9.0.21.55.2.
What is the output of these commands before the upgrade to 9 fails?

grep -C 5 debconf/priority /var/cache/debconf/config.dat

fresh install version 9. But in both cases there was the same
error.

Did you see the debconf question "Do you accept the license and do you
want to download the flash plugin now" when upgrading to 9.0.21.55.2 ?

If you did not see any questions, then you implicitly answered "no",
hence the "download or license refused".
The question is now why you did not see any questions. Could you verify
your debconf settings (dpkg-reconfigure debconf), and try again?

Yes, after reconfiguring and changing interface from
"Noninteractive" to "Dialog" the package installed successfully
with version 9.
Nevertheless, You should alter default answer to "Yes" on question
about licence and write more explanatory error message.
I am using automated upgrade, and thus any package should be
installed or upgraded noninteractively.

P.S. Before solving this problem, I've extracted URL from Your
script, downloaded and installed flash-plugin manually without
debian package. No problems, if don't make one on the flat
ground with hell's licence.

Have you read these bugs? Probably not, and that's OK. :)

362826 debconf priority "high" hides debconf question about downloading

In summary :) the user must be aware of the non-free license so there
must be a debconf question about the license, the default to the
question must be to refuse the license so that the user does not
unknowingly accept the license with "noninteractive", this default is
not "reasonable" as meant in "man debconf-devel" so therefor priority
"high", and the package must fail to install if the flash plugin itself
is not installed.
So, with the above-mentioned bugs fixed, it is normal that
"noninteractive" fails to install. I could change that to succeed, but
that would revert part of the previous changes.

Do You think that is normal if user can not install package and
don't know what to do? This occur in the normal situation and
not cause by any bug. Is it OK? I don't think so.
There are good practice for some packages after upgrade or
install send email with important notification. If the debian
policy require user aware about non-free licence, then You can
do this by email. And once more: You should provide clear error
message to point to what to do.

Good news: upgrade flashplugin-nonfree (9.0.21.55.2 =>
9.0.21.55.3) produce the same error: "download or license
refused" dpkg -a --configure ask two idiot questions and You can
give any answer - no sense.
It is time to finish: I will remove this package and advice all
debian users to do so. And it is better if You remove it from
debian distribution at all. It is not compatible with life.

If you tried that with debconf interface "noninteractive", then this is
no surprise; see the previous comments on this bug report.
If you tried that with debconf interface "dialog", then you are welcome
to describe this problem in detail in a separate bug report.

If "dpkg -a --configure" made two questions appear, then this means that
you were not using debconf interface "noninteractive". If the two
questions led nowhere, then you are welcome to describe this problem in
detail in a separate bug report.
I would like to keep the scope of this bug report to discussing the
package lacking support for debconf interface "noninteractive".
A solution could be to change the default answer to the question about
the license to "yes" and to add a warning to the package description.
The warning could be this:
"WARNING: Installing this Debian package causes the Adobe flash plugin
to be downloaded from www.adobe.com. The distribution license of the
Adobe flash plugin is available at www.adobe.com. Installing this
Debian package implies that you have accepted the terms of that
license."
That would make the flashplugin-nonfree package work with
"noninteractive", if the system has a working network connection.
