Sorry, but the license doesnt really fit the package. You have a php
addon thing, using PHP license 2.02, but unfortunately for you this
license cant really be used with anything else than PHP itself.

It always only talks about "the product PHP", not about software.
And "php-whatever" isnt really "PHP" from the PHP group.
Point 5 in the older version 2) is also an advertisement clause.
Bad thing which is usually discouraged.

And, at the end there is the following text:

I doubt that your package is made "on behalf of the PHP group". Or that
it includes the Zend Engine.

As a good solution for this I suggest to talk to your upstream. Looking
at the license they choosed they do want to make it available for
everyone, so I suggest to use either the original BSD license or the
LGPL.

The other solution is to reassign this bug to ftp.debian.org requesting
the removal of this package.

Hi,

As you may already be aware, a Debian package of your PEAR XML_Parser
module has been created for distribution as a part of Debian (and
thereafter all of its derivatives). Unfortunately, it was discovered
that the PHP License under which XML_Parser is released is problematic
for software other than PHP itself. This problem has already been
brought before the PEAR community, and is being actively worked on.
If you are interested, you can read about the problems with the
license (when applied to software other than PHP) and some of the
ensuing discussion at:

or in one of the PEAR mailing lists which were also involved in the
discussion.

To give you a sense of how uncompatible the PHP License is for the
release of software other than PHP, please consider point (6) of version
3.0:

    "Redistributions of any form whatsoever must retain the following
    acknowledgment: 'This product includes PHP, freely available from
    <http://www.php.net/>'."

While this is perfectly reasonable when distributing PHP itself, it
would be silly to think that you really expect us to only distribute
XML_Parser bundled with the entire PHP distribution. :-)

The PEAR team is currently working on how they would like to address
this issue:

But in the meantime, Debian is forced to remove PHP Licensed packages
(except of course for PHP itself) in order avoid violating the license.

We would, however, love to keep XML_Parser in Debian if you are able to
change the licence to something more compatible with your package. The
BSD License is quite similar to the PHP License. In fact, the first two
clauses of the PHP License were drawn from the BSD License. You can find
an example BSD License at:

Note that the third point is optional, and is often left out.

We hope that you'll be able to migrate XML_Parser to a license that is
not specific to PHP itself, in order to allow us to distribute it in
Debian.

I just wanted to make sure that all relevant RC bugs were aware of the
following debian-legal post by MJ Ray:

   "The PHP licence could be OK for any software which has PHP Group
   contribution (regardless who is licensing later), but would require 
   lying about other software. So, it is possible for others to use it 
   'freely' when PHP Group was involved upstream and avoid the problem
   you describe.

   "Please leave the PHP licence bugs open for software which has no
   contribution by the PHP Group (which seems true for one or two pear
   packages IIRC). I don't think the PHP licence can be accepted as
   always-OK for others yet."

Of course his comments are not binding on Debian, but they do express a
train of thought which has not been satisfactorily refuted on
debian-legal.

To summarize the long and continuing thread on "Clarification regarding
PHP License and DFSG status", there have been many comments questioning
the freeness of the PHP License, but there has been no refutal to my
proposal (agreed to by MJ above) that whatever the status of the PHP
License in Debian, it be applied equally to PHP and PHP Group software.

Just to clarify the context of my previous message, in November Pierre
from the Pear Group reported[1] that the PHP License was modified to
address the most severe of our concerns about its freeness. The
resultant license, unlike the previous version, appears to at least
apply equally to PHP and other PHP Group software, such as Pear
packages.

While debian-legal still feels that the license remains problematic, and
it is probably a good idea to encourage your upstream package maintainer
to adopt a new license, it is not entirely clear whether or not these
bugs are truly release critical, assuming that they deal with Pear
packages, which I have not taken the time to verify. The PHP License
clearly remains unacceptable for all non-PHP Group software.

Hi,

For all current RC bugs in Pear packages that use the PHP License, I am
downgrading the severity to important, and requesting that
debian/copyright be updated to the new PHP License, version 3.01. This
new license has been modified making it equally suitible for use by PHP
Group software as for PHP itself. The culmination of the discussion
motivating this current change can be found at [1].
