xli says that there are only 21 chars:

These bytes are there, and the length in the JPG even says 0x17 = 23.
Anyway, file doesn't really understand the contents of any file and in
this case reads the comment up the next NULL byte, which unfortunately
includes the two bogus bytes. There’s not much that can be done about
that, I’m afraid, short of removing the comment display altogether.

This is the part at which you explain:
a) how you got file to show you the comment, since I can't even get it
to do that much if I save a fresh image from The GIMP
b) how this is a gimp bug when ImageMagick, jhead, and xli all display
the comment correctly. Even if you use ImageMagick to add a comment to a
JPEG with -comment, the comment will be in the exact same format as if
GIMP wrote it - 0x17 is 2 more bytes specified than is actually
contained in the comment, and the comment trailed by \377\333. file will
still display extra character(s), at least an extra space.
Additionally, the following comment is located in libmagic1's magic file:
Note that these tests are not fool-proof since some perfectly valid
JPEGs are currently impossible to specify in magic(4) format.

now there is only the \377 appended, not two characters.
Of course all other programs, e.g., identify(1), have no characters
appended at all.
