It seems mount does attempt to perform the remount. However, it reports
the wrong error (must specify filesystem instead of busy).

Can you explain further?  Specifying the filesystem type does not help. 
The cause of the problem is that the filesystem is busy, not that the
filesystem type was not specified on the command line.

Specifying the device, mountpoint and filesystem type
will remove the guessing part from mount.
If something goes wrong during guessing, mount says "sorry -
you didnt tell me what to do, and I guessed something, but
it didnt work".

If you give a complete command and it goes wrong then mount will
no doubt give more precise diagnostics.

# mount -o remount,ro -t ext3 /dev/hda7 /mnt/hda7
mount: /mnt/hda7 is busy
