Suggested fix:

  add a zhm --no-boot flag that suppresses the HM_BOOT;
  add a signal handler for restart (HUP would do) that re-exec's with
  the --no-boot flag.  

(and of course, have /etc/init.d/zhm restart use it.  And do
bind-package-style deferred restart: ie. *don't* stop it at the
beginning of the upgrade, just restart it at the end.  Since you'll
just be signalling zhm, you're not vulnerable to the "start-stop-daemon
with changed binary" bug.)
